Terms and Conditions

Please read these Terms and Conditions carefully before using Promise.

Interpretation and Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

• Affiliate: An entity that controls, is controlled by, or is under common control with Promise.
• Application: The Promise software program provided by the Company, downloaded by You on any electronic device.
• Application Store: The digital distribution service operated by Apple Inc. (Apple App Store) in which the Application has been downloaded.
• Company: Viral App Dev LLC (referred to as “the Company,” “We,” “Us,” or “Our”).
• Device: Any device that can access the Service, such as a computer, cellphone, or tablet.
• Service: The Promise application and website.
• Subscriptions: The services or access to the Application offered on a subscription basis by the Company to You.
• You: The individual accessing or using the Service, or the company or legal entity on behalf of which such individual is accessing or using the Service.

Acknowledgment

By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of the Terms, You may not access the Service.

You represent that You are at least 13 years of age. If You are under 18, You represent that You have obtained verifiable parental or guardian consent to use the Service. The Company does not permit those under 13 to use the Service.

Subscriptions

Subscription Period

The Service or some parts of the Service are available only with a paid Subscription. You will be billed in advance on a recurring and periodic basis (such as weekly, monthly, or annually), depending on the type of Subscription plan You select when purchasing the Subscription.

At the end of each period, Your Subscription will automatically renew under the exact same conditions unless You cancel it or the Company cancels it.

Subscription Cancellations

You may cancel Your Subscription renewal through Your Apple App Store account settings or by going to Your Device's Settings > [Your Name] > Subscriptions, selecting Promise, and tapping “Cancel Subscription.” You will not receive a refund for the fees You already paid for Your current Subscription period, and You will be able to access the Service until the end of Your current Subscription period.

Billing

Payment will be charged to Your Apple ID account at the confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel Your Subscriptions by going to Your account settings on the App Store after purchase.

Refund Policy

Except when required by law, paid Subscription fees are non-refundable. Certain refund requests for Subscriptions may be considered by the Company on a case-by-case basis and granted at the sole discretion of the Company. For refunds, please contact Apple Support directly or submit a request through the App Store, as Apple processes all subscription payments.

Account Deletion

You may delete Your account at any time by accessing the account settings within the Application. Upon deletion of Your account, Your personal data will be deleted in accordance with Our Privacy Policy. Please note that deleting Your account does not automatically cancel any active Subscriptions. You must cancel Your Subscription separately through the App Store before deleting Your account to avoid future charges.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, if You breach these Terms. Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

To the maximum extent permitted by law, We are not liable for any indirect, incidental, or consequential damages arising from Your use of the Service.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise.

Governing Law

These Terms shall be governed by the laws of the Commonwealth of Massachusetts, United States, excluding its conflicts of law rules.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

Apple App Store Additional Terms

The following additional terms apply to the Application when accessed through or downloaded from the Apple App Store:

• These Terms are between You and the Company only, and not with Apple. The Company, not Apple, is solely responsible for the Application and its content.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
• In the event of any failure of the Application to conform to any applicable warranty, You may notify Apple, and Apple will refund the purchase price (if any) for the Application to You. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
• Apple is not responsible for addressing any claims by You or any third party relating to the Application or Your possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
• In the event of any third-party claim that the Application or Your possession and use of the Application infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of any such intellectual property infringement claim.
• You represent and warrant that (i) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon Your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against You as a third-party beneficiary thereof.

You must also comply with all applicable third-party terms of service when using the Application (e.g., Your wireless data service agreement).

Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, We will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use Our Service after revisions become effective, You agree to be bound by the updated Terms.
